Terms of Service

These Terms of Service (“Terms”) govern your access to and use of flipanalyst.com(the “Site”) and any services offered through the Site (collectively, the “Service”), operated by FlipAnalyst (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Site. By using the Site, you represent and warrant that you meet these requirements.

2. Description of the Service

FlipAnalyst is a free online tool that helps real estate investors model the financial outcomes of fix-and-flip projects under various hard money loan terms. The Service includes a loan-comparison calculator and an optional lead-matching feature that connects users with third-party hard money lenders (“Lender Buyers”). The Service is provided for informational and illustrative purposes only.

3. No Financial, Investment, or Legal Advice

FlipAnalyst is a calculation tool. The numbers, projections, and outputs produced by the Service are illustrative estimates based on inputs you provide. They are not, and should not be relied upon as, financial, investment, tax, accounting, or legal advice. Real estate investing involves substantial risk, including loss of principal. Actual outcomes will vary based on factors outside the model.

You are solely responsible for your investment decisions. Before making any financial commitment, you should consult with a licensed financial advisor, accountant, attorney, or other qualified professional.

4. No Endorsement of Lender Buyers

When you opt in to the lead-matching feature, FlipAnalyst may share your information with one or more Lender Buyers as described in our Privacy Policy. FlipAnalyst is not a lender, does not originate loans, does not underwrite or approve loans, and does not endorse, recommend, or guarantee any Lender Buyer or any loan terms a Lender Buyer may offer. Any loan agreement you enter into is solely between you and the Lender Buyer.

You should independently verify the credentials, terms, and reputation of any Lender Buyer before signing any documents or providing additional information. We strongly recommend you read all loan documents carefully and consult a licensed professional before signing.

5. Accuracy of Information

You agree to provide accurate, current, and complete information when using the Service, including in the lead-capture form. You may not impersonate another person, provide a phone number or email address you do not own, or otherwise misrepresent your identity.

While we work to keep the Service accurate, we make no representations or warranties about the accuracy, completeness, or timeliness of any content on the Site, including loan terms, market data, or third-party information.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Reverse-engineer, scrape, or attempt to derive the source code of the Site
  • Interfere with or disrupt the Site or its servers
  • Submit malicious code or attempt to gain unauthorized access to the Site or any user account
  • Use the Service to harass, defraud, or harm any other person
  • Resell, sublicense, or commercially exploit the Service without our written consent

7. Accounts

The Service may allow you to create an account to save deals and access additional features. You are responsible for maintaining the security of your account, including the email address used to receive sign-in links. You agree to notify us immediately of any unauthorized use of your account.

We may suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms.

8. Intellectual Property

The Site, including its software, design, content, branding, and compiled data, is owned by FlipAnalyst and protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Site for your personal, non-commercial use, subject to these Terms.

The data you input into the calculator (deal details, lender terms) remains yours. By submitting it, you grant us a license to use it as described in our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLIPANALYST DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. FLIPANALYST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FLIPANALYST, ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, INVESTMENT LOSSES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF FLIPANALYST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FLIPANALYST'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR THE AMOUNT YOU PAID FLIPANALYST IN THE TWELVE MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlipAnalyst and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any information you submit to the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason. You may stop using the Service at any time. Sections 3, 4, 8, 9, 10, 11, 13, and 14 will survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Service after an updated version has been posted constitutes your acceptance of the revised Terms.
